Terms & Conditions

About this website

gemellinewbern.com is operated by Gemelli Italian Deli & Bagelry, 211 Pollock Street, New Bern, North Carolina 28560. The site exists to show our menu, our hours and how to reach us. Using the site means you accept these terms. If you do not accept them, please do not use the site.

Menu, prices and availability

We keep the menu on this site as accurate as we can, but a kitchen is a moving target. Dishes, ingredients, portion sizes and prices can change without notice, and items sell out. The menu published here is for information. The prices charged at the counter or shown in our ordering system at the moment you order are the ones that apply.

Food allergies and dietary needs

We prepare food in a shared kitchen that handles wheat, dairy, eggs, soy, tree nuts, peanuts, fish and shellfish. We cannot guarantee that any dish is free of a given allergen, and items described as gluten-free are prepared in the same space as items containing gluten. Tell us about an allergy before you order so we can tell you honestly what we can and cannot do.

Consuming raw or undercooked meats, poultry, seafood, shellfish or eggs may increase your risk of foodborne illness.

Online ordering

Online pickup orders are placed through Clover, a separate company. When you follow our order link you leave this website and your order, your contact details and your payment are handled under Clover's terms and privacy policy. We are responsible for preparing the food you ordered. We are not responsible for the operation of that platform.

If something is wrong with an order, call us at 252-631-2030 and we will make it right.

Gift cards

Gift cards are sold and administered through our gift card provider on its own website, under its terms. Gift cards are redeemable for food and drink at our New Bern location and are not redeemable for cash except where state law requires it.

Our Privacy Policy explains what information this site collects. In short: analytics cookies are used only if you accept them, and you can change that choice at any time with the Cookie settings link at the bottom of every page.

Using the site fairly

Please do not try to interfere with the site, get around its security, overload it with automated requests, or access the private editing dashboard without permission. The site is protected by Cloudflare, which may challenge or block traffic that looks automated or harmful.

Availability and accuracy

We provide this website as it is. We do not promise that it will always be available or free of errors, and we may change or remove any part of it at any time. Nothing on this site is a guarantee that a particular dish, price or opening hour will be available on a particular day. When it matters, call ahead.

Limitation of liability

To the fullest extent allowed by North Carolina law, Gemelli Italian Deli & Bagelry is not liable for indirect or consequential losses arising from your use of this website, such as lost time or lost profits. Nothing in these terms limits any liability that cannot lawfully be limited, including liability for personal injury caused by our negligence.

Governing law

These terms are governed by the laws of the State of North Carolina, and any dispute about them belongs in the state or federal courts serving Craven County, North Carolina.

Changes to these terms

We may update these terms. The current version always lives on this page with the date it was last changed. Continuing to use the site after a change means the updated terms apply.
